subject:       Council Consideration to Adjust September and October Public Hearing Agendas

PURPOSE

The purpose of this report to inform the Council of an opportunity to adjust the September 17 Public Hearing agenda. We offer possible items that could be delayed to the October 20 Public Hearing. We recommend that the Council adopt the Resolution to delay one or more items on the September 17 Public Hearing agenda.

BACKGROUND

This memorandum includes background information on the 6 agenda items tentatively scheduled for the September 17, 2008 Council Public Hearing. We offer an opportunity to consider delaying one or more items. The items on the agenda and information about where each items is in the process is provided below.

 

Tentative September 17 Public Hearing

 

• The Residences at Grove Park Zoning Atlas Amendment application is associated with the Grove Park Special Use Permit application that the Council considered in the spring and is scheduled to return on October 13.
• The Residential-Special Standards-Conditional zoning district text amendment application is associated with the above application and is therefore a continuation item. The Council voted to call a September 17 Public Hearing on this item in June.
• The UNC Innovation Center Special Use Permit application has a relatively large mailing list and is therefore expected to have a larger turnout of neighbors than any other agenda items. Notice of the September 17 Public Hearing was mailed on June 4, 2008.
• The bicycle and vehicular parking text amendment is a relatively small item, and may be less time-consuming than other items on the agenda, which was called for the September Public Hearing;
• The Saint Thomas More Catholic Church Master Land Use Plan Modification application was reviewed by advisory boards and commissions this summer and notice was provide for the September Public Hearing on June 4; and
• The Saint Thomas More Catholic Church Special Use Permit Modification was reviewed by advisory boards and commissions this summer and notice was provide for the September Public Hearing on June 4.

Tentative October 20 Public Hearing

• Aydan Court Zoning Atlas Amendment application
• Aydan Court Zoning Special Use Permit application

The Public Hearing schedule date provided to applicants is always represented as tentative. If the Council desires to adjust the September 17 Public Hearing agenda for a more balanced use of their time, they may choose to delay one or more of the above agenda items until the October 20 Public Hearing.

RECOMMENDATION

Based on where the agenda items are in the development review process and additional considerations, such as the anticipated turnout for the UNC Innovation Center, we recommend that the Council consider delaying the Saint Thomas More Catholic Church Master Land Use Plan and Special Use Permit Modifications applications until the October 20, 2008 Public Hearing.

Alternatively, the Council could optionally 1) delay other agenda items, or 2) make no changes to the September 17, 2008 Public Hearing Agenda.

Resolution A provides a resolution that could be adopted to delay one or more items from the September 17 Public Hearing to the October 20 Public Hearing.
