The purpose of this report is to request Council authorization for the Town
Manager to
enter into a contract to implement the public art component of the Community
Center Park Playground Retaining Wall Project.
$47,600 has been encumbered for this project by the Parks and Recreation Department. Project funds derive from the following: $25,000 from the current fiscal year CIP small parks improvement budget and $22,600 from the 2007-08 Community Center Capital Renovation budget in accordance with Percent for Art Ordinance. The artist contract amount will be $45,000. The remaining $2,600 will be for site preparation and construction costs.
In accordance with the Chapel Hill Percent for Art Ordinance, established March 4, 2002, that sets aside one percent of the total Capital Improvement Project budget for public art and the procedures established therein, the Office of Public Arts conducted an artist selection process for an artist to create an artwork at Community Center Park that also serves as a functional, low retaining wall to replace the existing wooden wall at the site. The initial selection committee meeting was held October 31, 2008. Notes from that meeting are included as attachment 1.
A nine member Artist Recommendation Committee (attachment 2) with representation from the Public Art Commission, Parks and Recreation, Engineering and Public Works Departments, an artist, outside public art administrator, a neighborhood representative and a park user considered the applications of eight eligible artists, and selected three of the artists to come to Chapel Hill for interviews.
The same Artist Selection Committee interviewed the three artists on January 27, 2009. The Committee unanimously selected David Finn, a former Chapel Hill resident, now residing and teaching in Winston-Salem to be the public artist for the project. At a meeting on February 11, 2009, the Public Arts Commission unanimously endorsed this selection.

These agreements would include provisions for a Public Art Review Committee overseeing the process and Council review of the proposed art design prior to the approval and commencement of implementation.
We recommend that Council adopt the attached resolution which would authorize the Town Manager to negotiate and execute agreements for public art consistent with the terms of the Percent for Art Ordinance
