SUBJECT: Dedication of a Sewer Easement on Town Property (Greendale Park)

The owner of a lot on Sugarberry Road has requested that the Town dedicate a sewer utility easement to the Orange Water and Sewer Authority (OWASA). Please see the attached letter from the developer. Adoption of the attached resolution would authorize the Manager to dedicate a utility easement within Greendale Park, adjacent to Sugarberry Road.
The Town-owned Greendale Park (Battle Branch Greenway) property is located adjacent to Sugarberry Road. OWASA maintains an interceptor sewer line along Battle Branch within Greendale Park.
The owner of a lot on Sugarberry Road intends to build a single-family home and has requested that the Town dedicate to OWASA an approximately 30 foot by 80 foot sewer easement across a portion of Greendale Park. The public sewer line would be extended from the Town property into the right of way of Sugarberry Road. The owner of the private home would then tie into the public line in the right of way. Please see the attached sketch. We have examined the area and agree with the owner that the sewer extension can be made with minimal impact to the park and little loss of vegetation. We agree that the proposed location is the best site for a sewer line extension.
The attached resolution authorizes the Manager to execute a Deed of Easement for the sewer line.
Manager’s Recommendation: That the Council adopt the following resolution authorizing the Manager to dedicate a sewer easement to OWASA, such easement being located on a Town property described as Chapel Hill Tax Map 55.A.8.

A RESOLUTION AUTHORIZING DEDICATION TO OWASA OF A SEWER EASEMENT WITHIN GREENDALE PARK ON LAND OWNED BY THE TOWN OF CHAPEL HILL, WHICH IS DESCRIBED AS CHAPEL HILL TAX MAP 55.A.8. (2005-06-15/R-14)
WHEREAS, the owner of a lot on Sugarberry Road has requested that the Town dedicate a sewer easement to OWASA; and
WHEREAS, the proposed easement would allow a sewer connection to be made to a new single family home;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Chapel Hill that the Town Manager is authorized to transfer to OWASA a sewer easement approximately 80 feet in length by 30 feet wide located within Greendale Park on Town land, which is identified as Chapel Hill Tax Map 55.A.8.
