SUBJECT:       Continuation of Consideration of the Europa Applications: Modification of Existing Special Use Permit and Application for New Special Use Permit

                       

DATE:             May 13, 2002

 

 

Tonight the Council considers action on a pair of applications discussed at the Council’s April 22, 2002 Public Hearing.  Those applications seek approval of:

 

1.      A Special Use Permit Modification for the Hotel  L’Europa/Village Office Park Complex; and

2.      A new Special Use Permit for the Europa Office Building.

 

The Council closed the Hearings on these two applications on April 22, 2002.  After discussing the Special Use Permit Modification application for the Hotel L’ Europa/Village Office Park Complex, the Council referred  Resolution E, Resolution for Denial (Attachment 5.b, page 19), to the Town Attorney for additional consideration and advice. 

 

Attached to this memorandum is a memorandum from the Town Attorney including a revised resolution that would deny the request to modify the Hotel L'Europa/Village Office Park Complex Special Use Permit.  Also attached are materials presented on April 22, with alternate resolutions of approval and denial for both applications.

 

Recommendation

 

Manager’s Recommendation:  For the first application:  Based on the information in the record to date, we believe that the Council could make the findings required to approve the Special Use Permit Modification for the Hotel L’Europa/Village Office Park Complex.  We recommend that the Council adopt Resolution A, the Town Manager’s Revised Recommendation (Attachment 5.b, page 10), approving the application with conditions.

 

Resolution E, attached to the May 13, 2002 memorandum from the Town Attorney (Attachment 1), would deny the Special Use Permit Modification for the Hotel L’Europa/Village Office Park Complex.

 

For the second application: Approval of the first application is a necessary prerequisite to approve the second application.  If the first application is denied, the second application becomes moot.  If the first application is approved, we recommend approval of the new Special Use Permit for the Europa Office Building with adoption of Resolution A in Attachment 5.c page 12.
