SUBJECT:   Appropriation of Payment in Lieu of Recreation Space Funds for Parks and Recreation Department Projects

PURPOSE

 

This memorandum provides information related to proposals to use payments in lieu of recreation space funds for the Community Center Park and Morgan Creek Trail. We recommend that the Council enact the attached budget ordinances, which would increase the Morgan Creek Trail budget in the non-bond multi-year fund by $105,982 and allocate $46,368 for a path and interior walkway renovation project at the Community Center Park and Bolin Creek Trail.

 

BACKGROUND

 

The developer of the Southern Village project made a payment in lieu of providing a pedestrian bridge over Morgan Creek in 2000. The Town is currently working on a plan to extend the Fan Branch Greenway Trail, which serves Southern Village, over Morgan Creek. Bids for the project may be let as soon as late 2008.

 

The Town received a payment in lieu of recreation space from the developer of the Terrace Townhomes project on Hillsborough Street in 2008.

 

DISCUSSION

 

We believe that the proposed projects meet the requirements of State law, which state that the funds must be used to acquire land or develop recreation, park or open space sites to serve the area that includes the development projects that generated the funds.

 

Morgan Creek Trail: We are currently finalizing detailed construction plans for the Morgan Creek Trail and expect to bid the project in late 2008 or early 2009 if all regulatory issues can be resolved in a reasonable time frame. The proposed budget is shown below:

At this time we anticipate that additional funds for construction will be needed from the 2003 Parks bond or other sources. We will prepare further funding recommendations once detailed cost estimates are completed.

 

Community Center Park and Bolin Creek Trail Renovations: We propose using the $46,368 received from the developer of the Terrace Townhomes project to renovate the interior walkways at the Community Center Park. If any funds remain we would then repair pavement damage and make drainage improvements to the Bolin Creek Trail.

 

All of the older asphalt paths at the Community Center Park need improvement. We believe that this is a priority project because of the heavy use of the park by very young users. Children on non-motorized vehicles such as in-line skates, bicycles, scooters, heely shoes, skateboards, and other mobile devices use the pathways on a daily basis.

 

If funds remain after the Community Center Park renovations we would then make repairs to sections of the Bolin Creek Trail that have begun to fall into disrepair due to tree root intrusion and previous flood events.

 

RECOMMENDATION

 

Greenways Commission: On March 26, 2008, the Commission voted unanimously (5-0) to recommend that the payment in lieu of recreation space from the Terrace Townhomes project be used, in the following priority order: to replace internal paths at Community Center Park, to repair sections of pavement on the Bolin Creek Trail, and repair a drainage problem on the Bolin Creek Trail.

 

Parks and Recreation Commission: On March 19, 2008, the Commission voted unanimously (8-0) to recommend that the Council allocate $46,368 in payment in lieu of recreation space funds received from the Terrace Townhomes project on Hillsborough Street to be used, in the following priority order:

 

 

Staff Recommendation: That the Council enact the attached budget ordinances [2008-04-28/O-1 and 2008-04-28/O-2], which would which would increase the Morgan Creek Trail budget in the non-bond multi-year fund by $105,982 and allocate $46,368 in the annual capital fund for a path and interior walkway renovation project at the Community Center Park and Bolin Creek Trail.
