subject: Reschedule Continuation of a Public Hearings: Residence at Grove Park, 425 Hillsborough Street Zoning Atlas Amendment and Special Use Permit Applications

Tonight’s meeting is the continuation of the September 17 public hearing for a proposal by RAM Development Company for the Residences at Grove Park Zoning Atlas Amendment Application and continuation of the October 15 hearing for the Residence at Grove Park Special Use Permit application. The purpose of this memorandum is to recommend that the Council’s consideration of the Zoning Atlas Amendment and Special Use Permit applications be delayed to the Council’s November 10, 2008 business meeting.
On October 15, we received a request (attached) from RAM Development Company requesting that the Council continue the public hearings on the above applications to November 10, 2008.
The applicant is currently working with an adjoining property owner on resolution to issues related to a Protest Petition with the rezoning application. The applicant hopes to resolve this matter prior to the November 10, 2008 hearing. The applicant is also requesting that the Council continues its discussion at tonight’s meeting on the proposed text amendment associated with the Residential-Special Standards-Conditional Zoning District.
We recommend that the Council adopt the attached Resolution to continue the public hearing for the Residence at Grove Park Zoning Atlas Amendment and Special Use Permit Applications to November 10, 2008.
