PURPOSE

The purpose of this report is to respond to a petition from residents of the Winter Hill Subdivision regarding the Morgan Creek/Kings Mill Road Neighborhood Conservation District process (Please see Attachment 1). Adoption of the attached resolution would refer the petition to the Morgan Creek/Kings Mill Road Neighborhood Conservation District process for further discussion.

BACKGROUND

On September 26, 2005, Mr. John McPhaul presented a petition to the Council on behalf of residents of the Winter Hill Subdivision asking to exclude their neighborhood from the Morgan Creek/Kings Mill Road Neighborhood Conservation District.  Mr. McPhaul explained that he and his neighbors did not wish to be a part of the Neighborhood Conservation District. The Winter Hill Subdivision is not located within the Town’s limits but is included in the Town’s zoning jurisdiction.

On June 15, 2005, the Council adopted a resolution to engage Clarion Associates to prepare and complete four Neighborhood Conservation Districts by April 2006.  The four neighborhoods are: Pine Knolls, Morgan Creek/Kings Mill Road, Coker Hills, and Greenwood.  The process for considering designation as a Neighborhood Conservation Districts is currently underway.

DISCUSSION

The first neighborhood meeting regarding the Morgan Creek/Kings Mill Road Neighborhood Conservation District was held on September 29, 2005.  Mr. McPhaul presented the Winter Hill petition to the attendees at that time.  The Winter Hill Subdivision was included in the proposed boundary of the Neighborhood Conservation District.  

One of the first steps of the Neighborhood Conservation District process is to establish the district boundaries.  Residents offered their opinions and suggestions for the neighborhood boundaries at the September 29, 2005 meeting. An item on the agenda for the next neighborhood meeting (to be scheduled) will be to present the attendees with a proposed boundary map of the Neighborhood Conservation District for consideration.  The attendees may recommend that the Council include or exclude the Winter Hill Subdivision from the boundaries of the proposed Neighborhood Conservation District for this area.  

Upon completion of Clarion’s work, we anticipate that the Council would schedule a public hearing to receive citizen comments on the proposed boundaries and guidelines for the Neighborhood Conservation District prior to consideration of adopting the overlay zone.     

RECOMMENDATION

That the Council adopt the attached resolution to refer this petition to the Morgan Creek/Kings Mill Road Neighborhood Conservation District process for further discussion.
