AGENDA #5f

MEMORANDUM

TO:                  Mayor and Town Council

FROM:            W. Calvin Horton, Town Manager

SUBJECT:       Report on Removal of Dilapidated Vehicles

DATE:             June 10, 2002

Since January 2002 sixty-six dilapidated vehicles have been removed from private property, properly stored, or have otherwise been brought into compliance with the Town Code.  The attached tracking sheet and maps illustrate the removal and resolution of Dilapidated Vehicle violations throughout Town.  Also attached are copies of the Flyer and Dilapidated Vehicle Notice in both English and Spanish that were used during the initial enforcement this year.

BACKGROUND

Over the last several months the staff of the Inspections Department and the Police Department has been working with property owners, tenants, and neighborhood groups in an effort to resolve dilapidated vehicle violations.  A list of complaints that had accumulated over the previous two years was used initially to begin enforcement.  By January, 2002 we located and contracted a towing service to remove vehicles that remain in violation following notification.  Between January and February eighty vehicles were posted with a flyer thirty days prior to formal notification.  In March a Dilapidated Vehicle Notice was posted on the vehicles and mailed to the property owners.  The final step of enforcement has been the removal of the vehicles that remain in violation of the ordinance following the deadline.

The resolution of the violations has varied.  Many vehicles were removed by tenants or property owners upon notification.  Some vehicles were repaired, and some were stored properly within a garage or under cover.  A few property owners have requested extensions of their deadlines in order to sell the vehicles.

When it is determined that the property will not comply with the ordinance, or when an authorization to tow has been completed, a towing service is contacted with the location and description of the vehicle to be removed.  Three vehicles remain in violation from the original list of eighty.  Eleven vehicles are pending removal by a towing service.
